By-Election in Batu Parliament Seat

In 1975, Menglembu MP Fan Yew Teng, the DAP lawmaker was found guilty under the Sedition Act and fined RM2,000 or six months’ jail. Even though the jail term was less than 12 month yet the law maker lost the seat due the the fines RM2,000. Under Article 48 of the Federal Constitution, an MP is disqualified if he is convicted of an offence and sentenced to imprisonment for a term of not less than one year or to a fine of not less than RM2,000.

The same condition goes to Y.B.Tian Chua. Yesterday High Court reduced from RM3,000 or six months’ jail after his appeal over the charge of biting a police officer during a protest in 2007. He and most of the Malaysian thought Tian Chua manage to secured his parliament seat but everything changed due to 1 cents. If the high court judge said the fine will be RM1,999.99 cents then he is secured but it was not.

Can he appeal? Yes but the problem is, he paid his fine. Can he appeal after he paid his fine? Well let the legal expertise discuss about it but based from the precedent case, the then lawyer for Fan Yew Teng said Tian Chua lost the seat. Just wait for the offcial declaration.

Revert from "NO Back Door" Policy?

The recent Cabinet reshuffle has created more disatisfaction among the BN component MP's since more senators who failed to win the seat was given the government postion. I still remember, after 2008 GE, Tun Pa Lah strees the "No Back Door" policy for the politicians who lost in GE to get their government position. But since than Najib's administration have abandon the policy. I feel the appointment of more senator's to government position is not a good move for Najib's administration.

Khoo Kay Peng asked “How can he appoint Palanivel as a deputy minister when Barisan Nasional rejected him as its candidate in the Hulu Selangor by-election?" A very logic question which need to be answered.

President and Party Irrelevant?

The day before the GAS launching, V.Mugilan said he will be able to gather 15,000 Indians to show, the disatisfaction against the party president who still refuse to retired even after enjoying the perks for 31 years. But the number didnt meet the expectation. Well I’m not going to give the justification on why couldn’t meet the numbers but ........

I believe there are 3 group of Indians today

i. Die hard supporters to DSSV. What ever you tell them they will not shift their support since for them supporting DSSV means their rice bowl is safe at least until the next general election. They do not bother about party’s survival as far as they survived.

ii. 2nd group is the die hard supporter to party but they look at DSSV as a failure leader. This group want DSSV to let go the position immediately. Most of the attendee’s on GAS launching comes from this group.

iii. The 3rd group which is the bigger portion represent the Indian community. This group has ignored mic and they dont bother either DSSV or Mugilan, MIC or GAS. For them the party and his struggle is irrelevant. This are the group will determine the future of MIC. While group 1 are only care for their rice bowl and for sure will vote for mic/BN definately group 2 and 3 will vote against mic/BN. Group 2 believe to remove DSSV, mic must lost the general election while group 3 want to see the change of government in next election.

I believe, GAS has achieved their objective despite the numbers was very low. If within 7 days and the last minutes change of location yet Mugilan can gather around 5k Indians, that shows the disatisfaction of Indian community are very high towards DSSV. More over the spontaneous action by an old man shows the disapointment of Indians on maica holdings scandal which will hunt DSSV, mic and to certain extent BN forever.

If BN really care for Indian votes then the best decision is ..........(you think on your own what is the best for party). When the voters believe their leader is relevant, party will become relevant too but when the leader becomes irrelevant then the party he/she lead will fall into the same category.
